Terms of Service

PoloPonies is operated by Codefox LLC-FZ, a company registered in the United Arab Emirates with its registered office at Meydan Grandstand, 6th Floor, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates, trading as “PoloPonies” (“PoloPonies”, “we”, “us”, “our”). By creating an account, listing a pony or otherwise using the site, you accept these terms. If you do not agree with them, please do not use the site. Our Privacy Policy explains how we handle your personal data, and our Cookie Policy explains the cookies we use.

You must be at least 18 years old, and legally capable of entering into binding contracts, to use PoloPonies. By using the site you confirm that you are. You must give us accurate information when you register and keep it up to date.

PoloPonies is a venue. We provide the platform on which sellers advertise polo ponies and buyers find them — nothing more.

• We are not a party to any sale. Any contract for the sale of a pony is made directly between the buyer and the seller. Its terms — price, payment, delivery, trial periods, everything — are for the two of you to agree.
• The service is free. There are no listing fees and no commission, and no payments are processed through the platform.
• We are not an agent, broker, escrow service or insurer for either side, and we do not own, stable, inspect or transport any pony listed on the site.

You need an account to list a pony or to reveal a seller’s contact details. Keep your sign-in credentials confidential: you are responsible for what happens on your account, and you should tell us immediately at hello@poloponies.co.uk if you believe it has been compromised.

Before publishing a listing, sellers must verify a mobile phone number by entering a one-time code we send by SMS. To prevent abuse, verification codes are capped at 10 per account per day. Your verified number is how interested buyers will contact you (see section 7).

When you list a pony, you must:

• describe it honestly and accurately — including its age, height, level of schooling, playing experience and temperament;
• disclose honestly what you know about its health and soundness, including any vices, injuries or ongoing conditions;
• list only ponies that you own or are properly authorised to sell;
• use only photos and videos that genuinely show the pony listed and that you own or have the right to use; and
• keep the listing up to date, and mark it as sold or remove it once the pony is no longer available.

Misleading listings let everyone down. We may edit, hide or remove any listing that we reasonably believe breaks these rules.

You are responsible for satisfying yourself about any pony before you buy it. We strongly recommend that you:

• view the pony in person and see it ridden or played;
• ride it yourself, or have your trainer do so;
• commission an independent pre-purchase veterinary examination; and
• agree the terms of sale with the seller in writing.

We do not vet, inspect or verify any pony listed on the site, and we make no promises about any pony’s condition, health, soundness, temperament, schooling or suitability for you. A listing on PoloPonies is the seller’s advertisement, not our recommendation.

To see a seller’s phone number, you must be signed in and ask to reveal the contact details for a specific listing; the number is presented as a WhatsApp link. Every reveal is logged — we record which account revealed which listing’s contact details, and when — and reveals are rate-limited each day. We do this to protect sellers from harvesting and abuse; our Privacy Policy has the detail.

You may use a seller’s contact details only to make and discuss a genuine enquiry about buying the listed pony. You must not:

• use them for marketing, cold-calling or promotion of any kind;
• harvest or collect contact details, or build any database of them;
• share, sell or pass them to anyone else; or
• scrape the site or use any automated means to obtain contact details or listing content.

Buyers may leave reviews of sellers, and sellers may reply publicly. Reviews must be honest, based on your own first-hand experience of dealing with the seller, and must not be defamatory, abusive or misleading. Do not use reviews to settle unrelated scores, post anyone’s personal information, or promote another sale. We may remove reviews or replies that break these rules, and repeated abuse may lead to suspension.

Anyone can report a listing they believe breaks these terms or the law. A listing is automatically hidden once it receives three independent reports, pending review. Our moderators may also hide or remove any listing, review or account at any time where we reasonably believe these terms have been broken, and may restore content where a report proves unfounded. We aim to be fair and proportionate, but the final decision on what appears on PoloPonies is ours.

You must not:

• list anything other than a polo pony genuinely offered for sale;
• post false, misleading or fraudulent content;
• impersonate any person or misrepresent who you are;
• harass, threaten or abuse other users;
• circumvent phone verification, reveal limits or any other security measure, or attempt to access another person’s account;
• scrape, harvest or bulk-download listings, photos or contact details;
• upload malicious code or otherwise interfere with the operation of the site;
• use the site in connection with fraud, money laundering or any other unlawful purpose, including any breach of animal-welfare law; or
• use the site to advertise unrelated goods or services.

You keep ownership of everything you post — your listings, photos, videos, reviews and replies. So that we can run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for example, resizing or cropping images) and promote your content, on the site and beyond it — including rendering listing previews when links are shared on social media or in messaging apps. This licence ends when your content is deleted from the site, except for copies held in routine backups or that we must keep to meet our legal obligations.

You confirm that you have all the rights needed to post your content and to grant this licence. Note that listing photos are served from public storage: anyone who has a photo’s web address can view it.

The service is provided “as is” and “as available”. We do not promise that the site will be uninterrupted, error-free or secure, or that any listing is accurate.

To the maximum extent permitted by law:

• we are not liable for the condition, health, soundness, temperament, schooling or suitability of any pony listed on the site;
• we are not liable for the acts or omissions of buyers or sellers, including any misrepresentation, failure to complete a sale or failure to pay;
• we are not liable for loss of profit, business or opportunity, or for any indirect or consequential loss; and
• our total liability to you arising out of or in connection with the service is limited to £100.

Nothing in these terms excludes or limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded or limited. Nothing in these terms affects any statutory rights you have as a consumer under UK law that cannot be waived or limited by agreement — including any rights you may have against a seller who is acting in the course of a business.

If your breach of these terms causes us loss — for example, a claim from someone whose photographs you posted without permission — you agree to compensate us for the losses, costs and expenses we reasonably incur as a result. This does not apply to the extent the loss was caused by our own breach or negligence, and it does not affect your statutory rights as a consumer.

You can close your account at any time by emailing hello@poloponies.co.uk. We may suspend or terminate your account, or your access to features such as listing or contact reveal, if you break these terms, if the law requires it, or if we withdraw the service. Where practical we will give you notice and a chance to respond, but we may act immediately where a breach is serious. Sections that by their nature should survive termination — including sections 11 (for content that remains published), 12, 13 and 15 — survive it.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them. If you use the site as a consumer, you keep the benefit of any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts.

We may update these terms from time to time — for example, to reflect new features or changes in the law. If a change is material, we will give you reasonable advance notice by email or by a prominent notice on the site. Continuing to use PoloPonies after a change takes effect means you accept it; if you do not, you should stop using the site and may close your account.
